Practice Areas

Brian Fox, a Partner at Mullen Coughlin, focuses his practice on data privacy and security incident response and privacy litigation. As a victim organization’s Breach Coach, Brian coordinates the response by involving third-party incident response stakeholders – forensic investigation firms, data mining firms, law enforcement, etc. – to first mitigate and contain the incident, followed by identifying and counseling the victim organization on their legal and regulatory duties as it relates to state, federal, international data privacy laws and regulations. This includes reporting obligations to individuals and business partners, law enforcement and regulatory agencies, as well as with internal/external communications and procuring credit/identity monitoring for affected individuals. 

Brian also devotes part of his practice to defending organizations in single-plaintiff and class action privacy litigation. He has significant experience defending organizations against third-party claims for violations of various consumer protection statutes, fraud, negligence and breach of contract. He also has extensive experience in the oversight and coordination of state and federal litigation, including those matters ordered, coordinated and consolidated by the Judicial Panel on Multidistrict Litigation (JPML), as well as working with expert witnesses, handling investigation and discovery and preparing for (and engaging in) contested motion practice, oral argument, mediation, arbitration and trial.
