Brian Fox focuses his practice on privacy and data security matters, which may involve engaging forensics experts, complying with various state, federal, and international laws, interfacing with regulators, assisting with security enhancements and systems restoration and drafting and implementing data privacy and security-related policies and procedures. When a data privacy and security event occurs, he assists clients with locating the source of the breach, identifies affected individuals and prepares the legally required notice to individuals and regulatory officials.
Mr. Fox also has significant experience defending class action litigation addressing data privacy and security claims through all stages of litigation. These cases regularly include claims for violations of various consumer protection statutes, fraud, negligence and breach of contract. He has extensive experience in the oversight and coordination of state and federal litigation, including those matters ordered coordinated and consolidated by the Judicial Panel on Multidistrict Litigation (JPML), as well as working with expert witnesses, handling investigation and discovery and preparing for and engaging in contested motion practice, oral argument, mediation, arbitration and trial.
