Evan Berman is an Associate practicing in the Incident Response practice group. As Breach Counsel for organizations experiencing a data privacy and security incident, he coordinates the response and investigation into the incident with the various internal and external incident response stakeholders. This includes liaising with his clients’ cyber insurance carrier (if applicable); engaging with, and directing, digital forensic investigation and data mining firms; reporting to law enforcement, if necessary; and counseling on the legal, regulatory and contractual obligations stemming from the incident. He then, if applicable and appropriate, ensures timely and compliant notification to individuals regarding the incident and his clients’ response. Additionally, he assists his clients in responding to regulatory inquiries and follow-up investigations into data privacy and security incidents and other violative data privacy and security practices.
Evan was an estate planning attorney prior to joining Mullen Coughlin. He received his J.D from Temple University Beasley School of Law, while completing multiple legal- and tax-related internships as a law student. He received a Bachelor of Business Administration with a concentration in Business Law from the University of Michigan. He’s licensed to practice in both New Jersey and Florida.
Outside of his practice, Evan is the co-owner and CFO of a small start-up, Shore Schleppers, located in a New Jersey beach community.
