Andrew Bishop is an Associate in Mullen Coughlin’s Litigation practice, licensed to practice in Pennsylvania. A highly accomplished and experienced attorney, Andrew has over 20 years of experience in trial advocacy, data privacy and related regulatory compliance. At Mullen Coughlin, Andrew focuses his practice on defending organizations across all industry sectors against single-plaintiff and class action privacy and security claims related to data privacy and security incidents and data breaches; violations of federal consumer protection and U.S. state privacy laws and other commercial torts; breach of contract; and Tech E&O matters. While generally industry-agnostic, Andrew is well-versed in the intricacies of highly-regulated industries such as healthcare and life sciences, education and financial services.
Prior to joining Mullen Coughlin, Andrew maintained a litigation practice at a regional criminal defense and civil litigation law firm. There, he served as lead counsel on over 70 civil and criminal matters and also served as Data Privacy Counsel – drafting and negotiating privacy agreements for school districts and group health plans. Through this experience, Andrew is experienced in the nuances of federal data privacy laws such as the Health Insurance Portability and Accountability Act (HIPAA) and the Family Educational Rights and Privacy Act (FERPA), as well as state-specific privacy and data breach laws.
Prior to that, Andrew served as Counsel for Regulatory Affairs and Compliance at one of the nation’s largest integrated healthcare organizations. In that capacity, he provided legal guidance on health insurance operations, regulatory compliance and issues arising under the Affordable Care Act (ACA). Additionally, he also served as the principal legal advisor for compliance with the Telephone Consumer Protection Act (TCPA), Telemarketing Sales Rule (TSR), CAN-SPAM Act and other related telecommunications and marketing laws. In that role, he helped design and implement a revitalized enterprise-wide compliance program, expanding its scope and structure across the organization’s insurance, hospital and dental networks.
Andrew is also a retired U.S. Army Judge Advocate with more than 22 years of active-duty military service, including 16 years as an Officer with the U.S. Army Judge Advocate General’s (JAG) Corps. Over the course of his military career, he served as a Company Commander deployed in support of Operation Iraqi Freedom and held multiple senior legal positions advising general officers and command organizations in the United States and abroad. His notable assignments in the JAG Corps include serving as the senior legal advisor (Staff Judge Advocate) to the Commanding General of the First Army Division East; Chief Legal Counsel for the U.S. Army NATO Brigade, where he advised U.S. leadership assigned to NATO commands on international, administrative and operational law matters; and Chief of Administrative Law for the U.S. Army Communications-Electronics Command (CECOM), where he provided legal counsel on a wide range of federal administrative, ethics and privacy matters, including advising the Kirk U.S. Army Health Clinic at Aberdeen Proving Ground on HIPAA compliance during the COVID-19 pandemic. He also served as Command Judge Advocate to the Commandant of the U.S. Army War College. In that role, he served as the principal legal advisor to the two-star general commanding the institution and its academic programs, providing counsel on a wide range of issues, including ethics, investigations, personnel, compliance and privacy matters arising under the Privacy Act of 1974, FERPA, HIPAA and federal regulations governing electronic communications and data privacy. He also served concurrently as the Installation Judge Advocate for Carlisle Barracks. In addition to those responsibilities, Andrew developed and taught a graduate-level online elective on war crimes and international military tribunals for the War College’s Strategic Studies master’s program for five years.
In addition to a J.D. and M.P.I.A. from the University of Pittsburgh School of Law, Andrew also holds a Master of Laws in Military Law from The Judge Advocate General’s Legal Center and School and a Master of Laws in Healthcare & Pharmaceutical Compliance from Drexel University Thomas R. Kline School of Law.
In recognition of Andrew’s commitment and understanding of data privacy law and the legal and regulatory landscape, he holds numerous certifications including a U.S. Certified Information Privacy Professional (CIPP/US), Europe Certified Information Privacy Professional (CIPP/E) and Certified Information Privacy Manager (CIPM) from the International Association of Privacy Professionals, as well as healthcare industry-related compliance certifications from the America’s Health Insurance Plans (AHIP).
