Daniel Yosef is an Associate in Mullen Coughlin’s Incident Response practice group. He focuses his practice on providing legal counsel to organizations who have suffered a data privacy and security incident in order to minimize the harm to finances, business operations and legal and regulatory liability.

As Breach Counsel, Daniel leads the response and investigation into a data privacy and security incident alongside his clients’ internal incident response team (if applicable), cyber insurance claims teams and other third-parties. He often directs the forensic investigation into an incident to determine the nature and scope of the incident. He then, using information gleaned from the forensic investigation, counsels his clients on the relevant U.S. state, federal and international data privacy and information security laws and regulations that pertain to the organization and their obligations flowing from said information. He then assists, oftentimes in partnership with external vendors, in effectuating said notices to individuals, business partners, law enforcement and regulatory agencies and the media.

In counseling his clients, Daniel relies on his experience and aptitude in understanding various data privacy and security laws and regulations, including the California Consumer Privacy Act (CCPA), and its amendment the California Privacy Rights Act (CPRA), as well as other comprehensive state privacy laws. He also is well-versed in U.S. federal laws including the:

  • Gramm-Leachy-Bliley Act (GLBA)
  • Federal Trade Commission Act (FTCA)
  • Fair Credit Reporting Act (FCRA),
  • Fair and Accurate Credit Transactions Act (FACTA); and
  • Health Insurance Portability and Accountability Act (HIPAA), among others.

During, and after, a data privacy and security incident investigation, Daniel also assists his clients in responding to inquiries and follow-up discussions from U.S. state and federal regulatory agencies including the Securities and Exchange Commission (SEC), U.S. Department of Health and Human Services and it’s Office for Civil Rights (HHS-OCR), state Attorneys General and other state department of health, insurance and/or financial services.

Prior to joining Mullen Coughlin, Daniel was an associate with a large, full-service AmLaw 100 law firm. He is licensed to practice in California and received his J.D. from Loyola Law School in Los Angeles, CA. He is conversational in both Hebrew and Spanish.

  • Counseled hundreds of organizations across virtually every industry sector in investigating and responding to data privacy and security incidents
