David Moncure is a Partner in Mullen Coughlin’s Litigation practice group where he focuses on defending organizations across all industry sectors in class action, single-plaintiff and B2B data breach and privacy-related disputes. David has 20 years of experience in both in-house and law firm settings providing strategic counsel to multinational and Fortune 500 organizations, translating legal and technical jargon into useable business intelligence to meet organizational needs and manage organizational data privacy and information security risk.

David has an adept understanding of the litigation landscape with a particular focus on the intersection of e-discovery, cybersecurity and information/AI governance. He frequently counsels his clients on cost-effective and defensible solutions in managing large volumes of electronically stored data and information, and on ways to identify and rectify data privacy and information security concerns. He regularly collaborates with legal, cybersecurity and IT teams to align technical operations with defensible litigation strategies.

Prior to joining Mullen Coughlin, David was a partner at a global accounting firm in the AI Governance consulting practice where he designed and implemented AI and information governance strategies, policies, frameworks and trainings for multinational and Fortune 500 organizations. He also advised clients on eDiscovery best practices as well as data privacy and security regulatory controls related to the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA) and industry-specific regulations.

Before that, David led the eDiscovery and information governance teams for a global Fortune 500 healthcare organization and acted as lead discovery counsel for enterprise litigation and government investigations, developing discovery strategy, negotiating ESI protocols, advising on proportionality, and coordinating discovery with outside counsel and vendors. He also was the Data Protection and Security Legal Counsel for a multinational oil & gas company, advising on regional and cross-border data privacy, security incident response and compliance as well as cross-border data transfers for litigation and investigations.

David has spent nearly his whole legal career serving as lead eDiscovery and legal advisor for cross-border litigation and government investigations. He also has valuable vendor selection and management experience for litigation and data privacy and security incident response matters. Furthermore, David’s legal background includes designing defensible discovery frameworks, implementing end-to-end EDRM technology solutions and managing large-scale document reviews in high-exposure matters.

David holds a U.S. Certified Information Privacy Professional (CIPP/US) from the International Association of Privacy Professionals (IAPP) and is a Certified Electronic Records Management Practitioner bestowed by the Association for Information and Image Management (AIIM). He received his J.D. from Duke University School of Law and a B.A. in English from Davidson College.
