Elena Valentine, an Associate, practices in the firm’s Incident Response practice area. As a “Breach Coach” for organizations who have suffered a data privacy and security incident – such as a ransomware attack, business email compromise or other unauthorized network intrusion – she guides her clients through the full lifecycle of the incident response process. She works closely with the victim organization, its cyber insurance carrier/broker (if applicable) and external vendors to quickly identify the nature and scope of the incident, engage law enforcement if necessary and identify any legal or regulatory obligations as a result of the incident. Once identified, she then assists in effectuating said obligations to comply with state, federal, international and/or industry-specific data privacy and security laws and regulations.
Elena previously served as a Judicial Law Clerk for the Hon. Michael R. Ostrowski, Jr. of the New Jersey Superior Court. There, she reviewed and orally briefed the Judge on weekly motion submissions, as well as drafting orders based on the Judge’s decision and communicating those orders to trial participants. She also gained valuable law firm experience as a Law Clerk with a litigation firm based in Philadelphia.
Elena earned her J.D. from Rutgers Law School, also being honored with the Excellence in Oral Advocacy Award. She was also a member of the Hunter Moot Court and the “Managing Research Editor” for Rutger’s Computer and Technology Law Journal; her article, “Biometric Data Collection and Use in the Age of Social Media: The Increasing Need for COPPA Updates Given the Decreasing Age of Internet Users,” was published in 2023.
