Kate Garofalo is an Associate practicing in Mullen Coughlin’s Incident Response practice. As an organization’s Breach Counsel, she coordinates the response and investigation into data privacy and security incidents by overseeing and managing third-party vendors; liaising with cyber insurance resources, law enforcement and regulatory agencies; counseling on compliance with legal, regulatory, and contractual obligations such as notification, and effectuating such notices; and handling post-incident communications and regulatory follow-up (if applicable). Kate is industry-agnostic, however, has extensive experience with highly-regulated industry sectors such as the financial services industry and the education industry.
Prior to joining Mullen Coughlin, Kate was the Associate General Counsel (AGC) at a leading financial services technology company specializing in cryptocurrency investment. There, she advised on time-sensitive, incident-driven regulatory and compliance matters arising from various operational departments across multiple U.S. jurisdictions. She also drafted, negotiated, and managed vendor agreements and contracts involving data confidentiality, handling, and compliance.
Kate received her J.D. from University of Oregon School of Law with pro bono honors, and a B.A. in Political Science cum laude with a minor in Philosophy from Loyola Marymount University.
During law school, Kate gained significant insight into the federal judicial process by serving as a Judicial Extern to both the Honorable Barry T. Moskowitz and the Honorable Larry A. Burns of the U.S. District Court for the Southern District of California. In these roles, she assisted in the research and drafting of proposed orders in complex civil, employment, and consumer class actions, including dispositive orders evaluating the enforceability of arbitration agreements and class action waivers.
