Kevin M. Krauss, an Associate in Mullen Coughlin’s Privacy Litigation practice group, is a seasoned attorney with nearly a decade of civil litigation experience. His current practice focuses on representing organizations in single-plaintiff, class action and B2B disputes stemming from allegations related to data privacy and information security, such as data breaches; violations of state and federal consumer protection and data privacy laws; and breach of contract, among others.

When his clients are faced with potential litigation, Kevin works to identify and understand the appropriate legal issues at hand so that he can effectively counsel his client on any viable defense options to be used prior to, or at, arbitration, mediation or trial. He then works hand-in-hand with the organization, it’s important stakeholders and other Mullen Coughlin team members to develop a litigation strategy that takes into consideration his client’s goals and objectives, while also aiming to preserve its reputation, financial bottom line and continued business operations. He also, should it be required, responds to state, federal and industry regulatory agency investigations into alleged violations of data privacy and information security regulations.

Prior to practicing in the firm’s Privacy Litigation practice, Kevin served as Breach Counsel for organizations who suffered a data privacy and security incident such as a ransomware attack, business email compromise, inadvertent disclosure or other unauthorized network intrusion. His understanding of the legal and regulatory responses to these types of incidents, as well as the ins and outs of incident response, is experience he bears when counseling his clients on their dispute resolution.

Before joining Mullen Coughlin, Kevin spent five (5) years as a civil litigator at a boutique litigation firm, after four (4) previous years as a solo/small firm practitioner. His civil litigation practice consisted of defending hundreds of insured and self-insured entities against a variety of tort allegations such as personal injury and property damage, as well as with other negligence, insurance defense and real estate disputes, in both state and federal courts and on appeal.

Kevin received his J.D. from Widener University Delaware Law School, where he received the pro bono distinction. He was also President of the International Law Society, Student-President of the International Law Students Association (ILSA) and spent a semester abroad at the University of Nairobi Law School.

Kevin has always enjoyed giving back to his community through various volunteer activities. As a lawyer, he has assisted veterans and first responders with drafting wills with the Pennsylvania Wills for Heroes program. He has also volunteered with multiple election campaigns and voting integrity programs, most recently serving as a trained Legal Observer and Poll Watcher with the PA Victory Counsel Voter Protection Team during the 2016 general election.
