An Analysis of Standing in Texas Data Breach Class Actions

Mullen Coughlin Privacy Litigation Partner Amanda Harvey and Associate Kayleigh Watson recently had their article, โ€œAn Analysis of Standing in Texas Data Breach Class Actions,โ€ published in the Dallas Bar Associationโ€™s January 2025 edition of Headnotes.

In the article, Amanda and Kayleigh examine the impact of the conflicting rulings that federal courts have issued regarding the issue of establishing standing in data breach litigation. With respect to Texas in particular, the authors highlighted two recent cases โ€“ one in the Southern District of Texas and one in the Western District of Texas โ€“ that both tackled the standing issue, but each coming to a different decision.
